1. Health, fitness, safety and skill set: Any participant that enters into a tour contract with Moto Odyssey Australia Pty Ltd are stating and presenting that they are in suitable mental and physical condition, and that they are capable of participating on the Moto Odyssey Australia Pty Ltd tour without risk to themselves or others. Moto Odyssey Australia Pty Ltd participants are responsible for riding at their own pace and level of experience at all times during the tour. Moto Odyssey Australia Pty Ltd participants should at no time exceed their riding experience level or any of the local traffic laws and speed limits. Moto Odyssey Australia Pty Ltd participants are prohibited from exceeding State laws in relation to the consumption of alcoholic beverages while operating any vehicle/ motorcycle during a tour or the taking of ANY drugs (barbiturates, narcotics, hallucinogens, opioids) that may well impair judgement while riding. Moto Odyssey Australia Pty Ltd reserves the right to terminate their services to anyone for any infraction of the above. There is always a risk involved when any participant(s) are negligent, careless, or less experienced, this could cause harm or death to themselves or others.
2. Moto Odyssey Australia Pty Ltd reserves the right to accept or deny anybody from participating on a Moto Odyssey Australia Pty Ltd tour. Moto Odyssey Australia Pty Ltd does not and will not discriminate against any sex, race or religion. Moto Odyssey Australia Pty Ltd owners, operators or tour guides may for any reason deny a participant(s) continuance of the tour if they feel that the participant(s) is a danger or a disruption to himself or herself, tour group or the general public. Any participant(s) denied continuance of the tour is responsible for his or her own accommodation, meals, airport shuttle services or any other costs incurred as a result of their denial. No refunds will be issued to any participant(s) who are denied continuance of a Moto Odyssey Australia Pty Ltd tour.
The terms and conditions of this agreement, "travel" or "tour" relates to all activities and services provided, arranged or organised by Moto Odyssey Australia Pty Ltd, including but not limited to instruction sessions, transportation of any goods and/or persons by air, land or sea, tours and trips in the common sense, normal walk-through and/or remote areas, and all other activities related to the activities or services performed Moto Odyssey Australia Pty Ltd, however they may be connected. I (we) will hold harmless its owners, directors, employees and other persons or entities engaged in any business aspect of Moto Odyssey Australia Pty Ltd.
Moto Odyssey Australia Pty Ltd reserves the right to cancel any scheduled tour at any time due to lack of participation, severe weather, natural disaster, world unrest or any other given reason whatsoever. Moto Odyssey Australia Pty Ltd will immediately notify you and or the group of any such occurrence. Moto Odyssey Australia Pty Ltd will offer the possibility of rescheduling another tour on another date or will refund your tour cost less any deposits paid to cover our pre-booked accommodation and admin fees etc which will constitute a full settlement. All deposits required at the time of booking are non-refundable. Moto Odyssey Australia Pty Ltd, is not liable for any additional cost or losses incurred by the participant due to a Moto Odyssey Australia Pty Ltd cancellation of any tour. This may include, but not be limited to prepaid airline tickets, any other kind of accommodation reservations or any other pre-planned trips/travel and/or associated expenses.
